VicSmart

VicSmart is a streamlined assessment process for straightforward planning permit applications. Application identified in the Planning Scheme as being VicSmart have specified requirements for information, assessment processes and decision guidelines.

VicSmart is a streamlined assessment process for straightforward planning permit applications. Application identified in the Planning Scheme as being VicSmart have specified requirements for information, assessment processes and decision guidelines.

Key features of VicSmart include:

  • a 10-day permit process
  • applications are not advertised
  • information to be submitted with an application and what council can consider a pre-set.

If you do not qualify for VicSmart, you may be eligible to apply for Council's Fast Track service.

Applications that are eligible

VicSmart proposals may include the following.

Subdivision

  • Subdivide land to realign the common boundary between two lots
  • Subdivide land into lots each containing an existing building or car parking space
  • Subdivide land into an approved development into two lots

Minor extensions and structural changes

An application to construct or extend a dwelling, or make structural changes in a Mixed Use Zone or General Residential Zone must meet the following criteria:

  • the land must not be subject to a Heritage Overlay or Design and Development Overlay.
  • the land must meet the minimum garden area requirements once the proposed construction is completed, if associated with land within a General Residential Zone)
  • the structure does not exceed a building height of 5 metres.
  • the structure is not visible from the street, other than a lane, or public park.
  • the requirements in the following standards of Clause 54 of the Rescode:
    • A10 Side and rear setbacks
    • A11 Walls on boundaries
    • A12 Daylight to existing windows
    • A13 North-facing windows
    • A14 Overshadowing open space
    • A15 Overlooking.

Buildings and works (Zones)

  • Construct or extend a front fence within 3 metres of a street in a residential zone and/or Design and Development Overlay
  • Construct a building under $100,000 in value in a Mixed-Use Zone or in a General Residential Zone
    Where the building or works is not associated with a dwelling, and the building or works meets the standards of Clause 54
  • Construct a building under $500,000 in value in a Commercial zone; where the building or works is not within 30 metres of land (not a road) which is in a residential zone, or not associated with a use with adverse amenity potential or for a Brothel or Adult sex bookshop
  • Construct a building under $500,000 in value in a Capital City Zone; where the building or works is not associated with a use with adverse amenity potential
  • Construct a building under $1,000,000 in value in an Industrial Zone; where the building or works is not within 30 metres of land (not a road) which is in a residential zone, or not associated with a use with adverse amenity potential or for a Brothel or Adult sex bookshop

Buildings and works (Design and Development Overlay)

  • Construct a carport, garage, pergola, veranda, deck, shed or similar structure in a Design and Development Overlay
  • Construct an outdoor swimming pool in a Design and Development Overlay
  • Construct a building under $1,000,000 in value in a Design and Development Overlay where the land is in an Industrial Zone
  • Construct a building under $500,000 in value in a Design and Development Overlay where the land is in a Commercial Zone, Special Use Zone or Capital City Zone

Buildings and works (Neighbourhood Character Overlay)

  • Demolish, remove and/or construct an outbuilding (including a carport, garage, pergola, veranda, deck, shed or similar structure)
  • Demolition, remove and/or construct a fence
  • Remove, destroy or lop a tree
  • Construct a domestic swimming pool/spa and associated equipment and fencing
  • Construct a rainwater tank

Buildings and works (Heritage Overlay)

  • Demolish, remove and/or construct an outbuilding (including a carport, garage, pergola, veranda, deck, shed or similar structure)
  • Demolition, remove and/or construct a fence
  • Externally alter a non-contributory building
  • External painting
  • Construct and install
    • domestic services normal to a dwelling
    • a non-domestic disabled access ramp
    • a vehicle crossover
    • a domestic swimming pool or spa and associated equipment and fencing
  • Construct a rainwater tank and/or a solar energy facility attached to a dwelling
  • Construct or display a sign
  • Lop a tree

Buildings and works (Special Building Overlay)

Buildings or works on land subject to a Special Building Overlay can be submitted to VicSmart.

Melbourne Water must assess Special Overlay VicSmart applications prior to lodging with Council. For more information, including How to apply under the Special Building Overlay, see VicSmart planning process.

Advertising signs

Display a sign in a commercial or industrial zone that is not:

  • within 30m of a residential zone
  • a pole sign
  • a sky sign
  • a reflective sign
  • internally illuminated, floodlit, electronic or animated
  • exceeding a total display size of 10 square metres.

Car parking

Car parking reduction by no more than ten spaces in all zones.

Loading and unloading requirements

Loading and unloading reduction or waiver in all zones.

Required documentation

  • VicSmart application form completed and the declaration signed
  • A current copy of Certificate of Title produced no later than three months from your lodgement date
  • Current Plan of Subdivision, if relevant, produced no later than three months from your lodgement date
  • Relevant fee paid
  • Proposed plans or documents
  • VicSmart Checklist completed
  • Photographs of the subject site and the street, only for applications visible from the street
  • Melbourne Water VicSmart approval documentation for sites in a Special Building Overlay (SBO)
  • Planning Fee Schedule including Discretionary
