Review of Heritage Overlay 3 - Amendment C72
Thursday 8 December 2011 - Minister for Planning has approved Amendment C72
The City of Port Phillip’s largest heritage area now has enhanced protection following the approval of Amendment C72 by the Minister for Planning.
Council has worked together with the community during the Review of Heritage Overlay 3 (HO3) to ensure improved protection for important heritage assets across the South Melbourne, Albert Park, Middle Park, and West St Kilda areas.
The Review was prepared for Council by experts Heritage Alliance and Built Heritage. A single ‘statement of significance’ has been replaced with seven new detailed statements which provide more relevant information on why each of these heritage areas is significant and what elements need to be protected.
The new statements have been incorporated into the planning scheme as part of the City of Port Phillip Heritage Review and will guide planning permit applications and decisions for individual properties in a way that protects the highly valued heritage character of these areas.
The scheme amendment has not changed the Heritage Overlay provisions or policy in the scheme, or the number of properties covered by heritage controls.
The Review of Heritage Overlay 3 involved extensive community consultation. The comments of over six thousand property owners were sought during the initial consultation phase, followed by formal public exhibition of the amendment. Community input contributed valuable knowledge on the heritage of these areas and assisted Council in refining the heritage statements.
Detailed Information:
The Review produced detailed Citations and Statements of Significance for seven smaller precincts, which together now cover the area previously affected by the single HO3 precinct.
The amendment reflects the seven smaller precincts and new Citations / Statements of Significance in the Port Phillip Planning Scheme through:
- Referencing the seven smaller precincts on the planning scheme maps and in the schedule to the Heritage Overlay
- Including Citations and revised property gradings in the Port Phillip Heritage Review 2000, which is an incorporated document to the scheme
Note: The amendment will not increase or decrease the number / extent of properties covered by the Heritage Overlay, nor will it alter permit requirements.
Specifically, Amendment C72:
- Made changes to Port Phillip Planning Scheme Maps (Map No’s 2HO, 3HO, 4HO, 5HO & 6HO) by deleting references to HO3 and replacing with references to seven new Heritage Overlay areas HO440, HO441, HO442, HO443, HO444, HO445 and HO446
- Updated the Local Planning Policy Framework by altering Clauses 21.05, 22.01, 22.04 to:
- Include the revised version number and date of the Port Phillip Heritage Review and Heritage Policy MaP
- Delete reference to HO3 and replace with references to HO440, HO441, HO442, HO443, HO444, HO445, and HO446, and
- Include the Review of Heritage Overlay 3, as prepared by Heritage Alliance (2009) & Built Heritage (2010) as a reference document to the Port Phillip Planning Scheme.
- Updated the Schedule to Clause 43.01 - Heritage Overlay, by deleting reference to HO3 and including reference to HO440, HO441, HO442, HO443, HO444, HO445 and HO446.
- Updated the Schedule to Clause 81 - Incorporated Documents, to incorporate and refer to the updated versions of the Port Phillip Heritage Review and City of Port Phillip Heritage Policy Map.
- Updated the Port Phillip Heritage Review, which is an incorporated document in the Port Phillip Planning Scheme by deleting the Citation for HO3, including new Citations for HO440, HO441, HO442, HO443, HO444, HO445 and HO446.
- The heritage grading of 22 individual properties on the City of Port Phillip Heritage Policy map was altered.
