Overview

In January 2006, Council commenced preparation of the Ormond Road Urban Design Guidelines, to guide built form within the retail centres of Elwood Junction and Elwood Village and the residential areas in between.  

The Guidelines are based on an assessment of the urban design values of Ormond Road, as well as feedback from community consultation. They consider likely development forms based on lot sizes and current market preferences and the potential impacts of buildings on local built form character, heritage, the amenity of the public realm and the amenity of adjoining private properties.

Adoption by Council

Council adopted the Guidelines in September 2006 and resolved to implement the findings of the Guidelines by an amendment to the Planning Scheme. This amendment is known as Amendment C57.

Amendment C57

Amendment C57 implements the Ormond Road Urban Design Guidelines through a Design and Development Overlay in the Port Phillip Planning Scheme.

The amendment introduces a new schedule (DDO18) to the Design and Development Overlay at Clause 43.02 of the Planning Scheme. The DDO18 applies to the two retail precincts (Elwood Junction and Elwood Village) and the two residential precincts within Ormond Road. Both the retail and residential precincts have a preferred character statement accompanied by design objectives and requirements that will assist new development in achieving preferred character outcomes.

Amendment C57 also rezones the land at 129 and 131 Ruskin Street from a Business 1 Zone to a Residential 1 Zone.

Exhibition and submissions

Amendment C57 was exhibited for a 1 month period between November and December 2006. During this time, submissions were invited from the public.

All submissions received to the amendment were consdiered by the Council in February 2007. The Council resolved to make some minor changes to the amendment documentation, and to refer all submissions to an independant Panel appointed by the Minister for Planning. Panel Hearing and Panel Report

The Panel Hearing was conducted on 21 May 2007. The Panel heard all submissions made to Amendment C57. Following the hearing, the Panel released their findings in a report in July 2007. The Panel recommended that Council consider adopting changes to the Design and Development Overlay, and also recommended that further notice be given in relation to changes to the residential precinct along Ormond Road, between Pine Avenue and St Kilda Street.

Amendment C57: Part 1 and Part 2

In line with the Panel's recommendations and the Council resolution from August 2007, Amendment C57 has been separated into two parts as follows:

  • Amendment C57 Part 1, incorporating the retail areas of DDO18-1 (Elwood Junction and Elwood Village) and the residential precinct DDO18-2 (Ormond Road, between Byrne Avenue and Beach Avenue).
  • Amendment C57 Part 2, incorporating the residential precinct DDO18-3 (Ormond Road, between Pine Avenue and St Kilda Street).

Amendment C57 Part 1 was approved by the Minister for Planning and gazetted on 10 April 2008. DDO18-1 and DDO18-2 now form part of the planning scheme, and the properties at 129 and 131 Ruskin Street are now zoned Residential 1.

Amendment C57 Part 2 - What it proposes

Amendment C57 Part 2 proposes to introduce planning scheme controls that will guide built form in the residential precinct fronting Ormond Road, between Pine Avenue and St Kilda Street. The controls are in the form of a Design and Development Overlay.

Differences between the exhibited Amendment C57 and Amendment C57 Part 2

The exhibited Amendment C57 proposed a maximum building height of 3 storeys (9 metres), however the Panel recommended that this be increased to a maximum of 4 storeys (13 metres). The Panel also made other recommendations in relation to the setback of buildings, the use of materials, and facade detailing.

Amendment C57 Part 2 therefore proposes to introduce controls (in the form of a Design and Development Overlay - Residential Precinct DDO18-3) in the Planning Scheme that:

  • limit new development to a maximum height of 4 storeys, or 13 metres;
  • allow the front wall of the building to extend up tp a maximum of 10 metres in height;
  • require a 4th level (if proposed), to be setback from the front so that it is not visible from standing eye level on the footpath directly opposite;
  • require a 4th level (if proposed) to be setback from the rear so that it is not visible from the rear building line of an adjoining residential property;
  • require a 4th level (if proposed) to appear as a lightweight element in the context of the total building structure;
  • require front setbacks to be a minimum of 6 metres, and require front setback areas to be landscaped.

In addition to the above requirements, the controls also encourage:.

  • the design of front and side street facades to be highly articulated;
  • side and rear setbacks to accord with Rescode (Clause 54.04-1 / 55.04-1);
  • overshadowing of private open space to accord with Rescode (Clause 54.05-5 / 55.05-5).

Amendment C57 Part 2 - Submissions

Amendment C57 Part 2 was exhibited for a period of 1 month, between 15 November and 17 December 2007. During this time, submissions were invited from the public. All submissions received to the amendment were consdiered by the Council in February 2008. The Council resolved to refer all submissions to an independant Panel appointed by the Minister for Planning. Amendment C57 Part 2 - Panel Hearing and Panel Report

Council submitted its report to the Panel on 16 May 2008. A formal hearing was not conducted, as no submitters to the amendment requested to be heard by the Panel.

The Panel considered all written submissions to the amendment and released their findings in a report in June 2008. The Panel recommended that Council consider adopting a minor change to the Design and Development Overlay, and also recommended two further minor changes be made to the wording of the provisions in the Design and Development Overlay approved under Amendment C57 Part 1.
