Beacon Cove Residential Planning Controls – Amendment C73
Approval of the Amendment:
Further to Council’s adoption of Amendment C73 to the Port Phillip Planning Scheme on 11 July 2011, the amendment has been approved by the Minister for Planning and came into operation on 24 November 2011, the date notice of approval was published in the Victoria Government Gazette.
The operation of the amendment includes:
- Implementation of new planning controls that reflect the completed development of the estate and revised planning policy and requirements to manage any future development. This includes rezoning to a Residential 1 Zone (where land is currently in residential use) and the introduction of Neighbourhood Character Overlays (NCO) and Design and Development Overlays (DDO) aimed at reinforcing the established character of the estate.
- Amended Schedule to Clause 52.02 Easements, Restrictions and Reserves to vary the covenants that relate to the low-rise residential precincts in Beacon Cove.
The change to the Schedule to Clause 52.02 Easements, Restrictions and Reserves of the Port Phillip Planning Scheme will facilitate the lodging of certified plans at the Land Victoria (for registration under section 23 of the Subdivision Act 1988).
Now that the amendment has come into operation, letters will be sent to landowners of the low-rise residential precinct of the Beacon Cove estate seeking their expression of interest to vary the covenant as it appears on Title.
What process did the amendment go through?
The amendment was placed on public exhibition from 5 May to 6 June 2011. Six submissions were received. Three submissions express support for the intent of the amendment and acknowledge Council’s efforts in bringing the complex amendment to fruition. A further three submissions raised issue specific objections, however these were subsequently withdrawn following discussion with Council officers.
Council considered the submissions and adopted Amendment C73 (with minor changes) on Monday 11 July 2011. View the 11 July 2011 Council Report, Minutes and adopted amendment here. The amendment was forwarded to the Minister for Planning for final approval following Council's adoption of the amendment.
