A Heritage Overlay for the 'Nightingale Street Precinct'

In June 2005, the City of Port Phillip appointed consultants, Heritage Alliance, to investigate the heritage potential of the residential area south of Carlisle Street (between Chapel Street and the rail line) in Balaclava.  This assessment formed part of the initial scoping for the Carlisle Street Structure Plan.  The heritage assessment concluded that the 'Nightingale Street Precinct' (i.e. an area of properties centred around Nightingale Street) warranted the the application of an appropriate conservation mechanism, in this case a Heritage Overlay.

In August 2006, Council resolved to pursue the introduction of a Heritage Overlay for the area identified as the 'Nightingale Street Precinct', by an amendment to the planning scheme. 

This amendment is referred to as Amendment C68.

Amendment C68 - Changes to the Planning Scheme

Amendment C68 proposes to introduce a Heritage Overlay (known as HO439) on the properties within the 'Nightingale Street Precinct'.

Exhibition and Submissions

During February and March 2008 Council publicly exhibited Amendment C68. The public were invited to make written submissions to Council regarding the amendment.  The closing date for submissions was Friday 14 March 2008.

In April 2008, all submissions received were referred to Council and considered at the Strategy and Policy Review Committee Meeting on 7 April 2008, where Council resolved to refer all submissions to an Independent Panel.

Panel Hearing and Panel Report

The Panel Hearing was conducted on 2 September 2008, during which the Panel heard all submissions made to Amendment C68. Following the hearing, the Panel released their findings in a report.

The Panel recommended that Council consider adopting Amendment C68 to the Port Phillip Planning Scheme to include the 'Nightingale Street Precinct' in a Heritage Overlay. The Panel also recommended that Council alter the Heritage Citation applying to the precinct to record that the building at 32 Nightingale Street, Balaclava was constructed c. 1902 and is the oldest Victoria-style dwelling in the precinct.

The Panel's findings will be reported to the Strategy and Policy Review Committee on 6 October 2008 for consideration. A copy of the agenda and minutes for October, including the officers report and recommendations, can be accessed at Council Meetings.
