New Footpath Trading Guidelines get the go-ahead

Council announced its support for the new proposed Footpath Trading Guidelines last night and will make its final decision on the guidelines on 16 June 2010. The Guidelines will help balance the many uses of our footpaths including pedestrian accessibility and safety, footpath dining, and business trading.

“Footpath trading is a valuable use of public space. It can improve the look of our streets and adds life and vibrancy to shopping strips. It supports a prosperous local economy,” said Mayor Cr Frank O’Connor.

“Footpaths are shared spaces, and we need to balance the differing community needs while improving the experience of all users,” he said.

The proposed revised Guidelines provide more specific standards for pedestrian zone widths, kerb zone widths, outdoor furniture, heaters, awnings and footpath signage, and ensures Disability Discrimination Act compliance.

The consultation process has resulted in a number of changes to the guidelines.

“Council has conducted a widespread consultation with residents and traders in preparing these guidelines. We’ve listened to what the community has said, and we believe we’ve found the right balance between the many uses of our footpaths,” he said.

Council will work with businesses to ensure a smooth transition and we will allow up to a 12 month period for traders to comply with the changes in the new guidelines.

Some traders may believe they have special circumstances and should have a variation from certain sections of the guidelines. If this is the case they can request a review by the council’s Footpath Trading Panel, who will consider their circumstances.

“Council’s in principle support of the guidelines means we are giving residents and traders another three weeks to view the guidelines and have their say before our final decision,” he said.

In order to commence the permit renewal process and ensure traders have valid permits for 2010/2011, council will be sending permit renewal notices in late May 2010. Council will review all permits with traders against the final version of the Guidelines from July to December 2010.
